When you can and can't claim against us

If your vehicle has been damaged while driving on EastLink, this page contains important information about when you can and can't claim against us.

While ConnectEast Group is the Responsible Road Authority for maintaining and operating EastLink under the Road Management Act (2004) (the Act), we are not responsible or liable for all loss or damage resulting from incidents that occur on EastLink.

Accident caused by you or another driver

ConnectEast is not liable for damage resulting from accidents caused by you or another driver. We suggest you discuss your options with your insurer, if you have not already done so.

Incident arising out of condition of road – property damage

The Act sets out when a Responsible Road Authority, such as ConnectEast, may or may not be liable for property damage for incidents arising out of the condition of a road.

ConnectEast is generally not liable for debris on or the condition of EastLink where we have complied with the relevant standards as stated in our Road Management Plan, Code of Maintenance Standards and/or Incident Management Plan.

There may be limited instances where ConnectEast may be liable for incidents arising out of the condition of EastLink.

Property damage amounting to less than $1,580

The Act states that ConnectEast is not liable for property damage for an amount less than the statutory threshold amount. The statutory threshold amount for the Financial Year 2023/2024 year is $1,580 and is indexed annually in accordance with CPI.

This means that if the amount of your claim for property damage is less than $1,580, ConnectEast is not liable. In those instances, we suggest you discuss your options with your insurer, if you have not already done so.

Property damage amounting to $1,580 or greater

If the amount of your claim for property damage is at least $1,580 and you wish to proceed with a claim against ConnectEast, you will need to print out, complete and sign the following claim form:

Once you have fully completed the form as per the instructions printed on it, you will then need to post it to the address shown at the top of page 2 of the form.

If ConnectEast is liable to pay property damage for an incident arising out of the condition of EastLink, any payment is reduced by the amount of the statutory threshold amount. For example, if you suffer $2,000 property damage and ConnectEast is liable to pay you compensation, then ConnectEast is only required under the Act to pay you $420 (i.e. $2,000 minus $1,580).

What happens after we receive your Notice of Incident and Claim Form

Following receipt of your Notice of Incident and Claim Form, we will consider your claim and advise you of ConnectEast's position.

Within 14 days of receiving a Notice of Incident and Claim Form, we may prepare a condition report. If we complete a condition report, we will provide you with a copy. This report may also be admissible in any Court proceedings.
